Business as usual it seems, with much confusion over the application.
Whilst the main dairy application [10/1397/FUL] has now been withdrawn by the applicants, for some bizarre reason the Digestate Pipeline [10/1522/FUL] and Reservoir applications [11/0059/FUL] remain in place.
Following a call to North Kesteven District Council (NKDC) yesterday, I understand the booking for full Planning Committee on 8th March 2011 remains in place. However, it is unclear what planning business is going to be debated as this date was reserved specifically for the dairy application.
What is clear though, is that the applicants felt the Digestate Pipeline and Reservoir were an integral part of their dairy plans... I think these were described as an 'essential element'. So why are these still required now the main dairy plan has failed to materialise?
Critically, there is an important administrative issue shortly to arise, with the Digestate Pipeline [10/1522/FUL] determination deadline fast arriving - Tuesday 1st March 2011 to be precise. Unless Nocton Dairies give permission for this deadline to be delayed, if NKDC fail to determine the planning application by this date, Nocton Dairies will have the right to take the pipeline application to appeal.
With regard to the Reservoir application [11/0059/FUL], the Determination Deadline is not until 25th Apr 2011, so is much less a pressing issue.
I have emailed Phillip Rowson of NKDC Planning Department for clarification and he has assured me he will let me know the position in due course. I quote from his reply dated 17th February:
"Perhaps, I could put your other queries on hold we await a response from the applicant regarding the two outstanding applications. A decision has not yet been made as to 8th March meeting, I will keep you briefed as the answers come to me."
