Many 'Say No to the Super Dairy' campaign banners have been taken down recently. I understand those residents have been visited by a representative of NKDC to politely request for these to be taken down whilst there is no current planning application in place. No statutory notice was served I believe and it is difficult to see whether this request could be enforced if residents decided to leave these in place.I will try to obtain more information on this matter and report back.
Update
Following a call to North Kesteven District Council by a local resident, it transpires such banners come under the 'Control of Advertisement Regulations'. Whilst a planning application is 'live', then the Council see this as a 'peaceful use of legislation in support of a campaign'. This does not however apply once the planning application is withdrawn. It is acceptable to display the banners supporting the campaign again, but only if the planning application is resubmitted.
Failure to remove banners after a formal notice has been served, will result in an offender appearing before Magistrates Court. A fine not exceeding £3,000 can be levied, with a 10% increase for every day the banner remains on display.
